Final Order / Judgement

Case is called out.

None is present on behalf of the appellants.  Sh. Arvind Singh Shah, learned counsel for respondent No. 2 is present.

Following order was passed by this Commission on 31.08.2022:

“Case is called out.

None is present on behalf of the appellants.

According to office report dated 30.08.2022, registered court notice was issued to the appellant No. 1 on 05.04.2022, which is not received back in the office as yet.

Office has submitted the tracking report of registered court notice issued to appellant No. 1, according to which, delivery of registered notice issued to appellant No. 1 is confirmed.  Accordingly, service of notice upon appellant No. 1 is held to be sufficient.

In the interest of justice, one more opportunity is provided to the appellants.

Put up on 15.09.2022 for hearing on delay condonation application.

Interim order dated 08.04.2019 is extended till the next date fixed.”

Inspite of that, neither anyone has appeared on behalf of the appellants, nor any adjournment application has been moved.

It appears that the appellants are not interested in pursuing this appeal.

Accordingly, the appeal is dismissed in default of the appellants.

Let the record be consigned.
