Final Order / Judgement

This Revision is directed against the order dated 12/07/2016 passed by the District Forum, Cuttack in C.C. no. 89 of 2016 where in a petition filed by the Opp. party/complainnat U/s.13 (3)(B) of C.P. Act it directed the petitioners to release the vehicle bearing Regd. No. OR-09J-4881 in favour of the opp. party/complainant on receipt of upto-date EMIs and further directing that opp. party/complainant to continue payment of all EMIs. as per the agreement.

Learned counsel for the petitioners submits that the dues pending aginst the present opp. party as on july 2016 is Rs. 3,05,404/- If the opp. party/complainant shall pay the said amount, the vehicle will be released in her favour.

learned counsel for the opp. party submits that the opp. party is willingand ready to pay Rs. 3,05,404/- provided one month time is granted.

In view of such submission of counsel of the parties,,, it is ordered that the opp. party/complainant shall pay Rs. 3,05,404/- to the petitioners by one month from the date of receipt of copy of this order. the petitioners on receiving the said amount shall release the subject vehicle in favour of opp. party without delay.

In view of such order, the revision petition is disposed of. Consequently the C.C. no 89 of 2016 pending in the file of District Forum, Cuttack stands disposed of.

The petitioners shall also  issue NOC in favour of the opp. party after of the agreed amount.
