Learned counsel for the appellant filed a Memo stating that

“ In the above mentioned Appeal during the pendency of the appeal, the appellant have already closed the loan account on 05.12.207 and the agreement stands terminated and NOC has already been issued on 06.12.2017. Therefore the appeal has become infructuous and the same may be diposed of accordingly.”

In such fact of matter the appeal stands disposed of on the terms and conditions of the memo filed by learned counsel of the appellant at the risk of appellant.

Statutory amount may be refunded to the appellant on proper identification.
