Final Order / Judgement

Heard learned counsel for the applicant.

This miscellaneous application has been filed by the applicant for releasing the amount of Rs. 25,000/-, which was deposited by the applicant towards mandatory deposit while filing First Appeal No. 178 of 2018; United India Insurance Company Limited Vs. Smt. Rekha Devi.

Learned counsel for the applicant submitted that the aforesaid appeal has been decided and the appeal has been dismissed.  His further submission is that the entire decretal amount of Rs. 5,86,947/- has been deposited by the applicant before the District Forum vide cheque     No. 393308, hence the aforesaid amount should be released in favour of the applicant.

Certified copy of order dated 08.07.2019 passed by the District Forum has been filed by the applicant, according to which, the entire decretal amount has been deposited, hence the realization certificate dated 10.06.2019 issued against the applicant has been withdrawn.

Considering the aforesaid facts and circumstances of this case, the grounds of this miscellaneous application appear to be proper and justified. 

Accordingly, the miscellaneous application is allowed and the aforesaid amount of Rs. 25,000/- deposited by the applicant at the time of filing the appeal, be released in favour of the applicant.

Let the record be consigned.
