Final Order / Judgement

Per Shri B.A.Shaikh, Hon’ble Presiding Member.

                  None for appellant is present. Perusal of the record and proceeding of the appeal shows that the appellant filed the appeal as back as on 22/04/2016. The Registrar of this Commission recorded five objections on 22/04/2016. The appellant was directed to remove those objections on or before 08/05/2016. It was also made clear that if the said objections are not removed as above, then the appeal will be placed before Circuit Bench for order. However as per report of Registrar dated 28/11/2017 the said objections not removed. Then appeal came to be registered subject to removal of the said objections. This Commission also issued separate notice dated 16/09/2017 to the appellant by Registered Post A.D., calling upon the appellant to remove office objection within 15 days and in case of default the appeal will be placed before Bench No.1 for appropriate order. The said notice has been also dully served to the appellant, but office objections are not removed. This Commission also displayed a separate notice dated 30/10/2017 on notice board of this Commission calling upon the concerned parties and their advocate to remove the office objections within 15 days. Thus it is seen that neither the appellant appeared before this Commission after service of notice, nor did remove the office objections. The appeal came to be adjourned till this date for appropriate order. Therefore we hold that appeal deserves to be dismissed in default. Hence appeal is dismissed in default.
