Final Order / Judgement

The Complainant is present through Ld. Advocate.

Today Ms. Anneswa Saha has entered appearance by filing fresh vokalatnama after taking NOC from the erstwhile Ld. Advocate.

Today the Complainant has filed an application supported by affidavit stating that the instant complaint has already been resolved by and between the Complainant and Ops out of Court and for this reason, the Complainant is not inclined to proceed with this Complaint further.

By filing this application the Complainant stated that if this application is not allowed, he will suffer irreparable loss and injury and prayer is made by the Complainant for allowing this application.

Upon careful perusal of the content of the application in our view as the dispute has already been settled by and between amicable settlement out of Court and where the Complainant is not willing to withdraw this complaint, we have no objection, hence the application as filed by the Complainant is allowed.

Going by the foregoing discussion hence it is ordered that the Consumer Complaint being no. 13/2019 is hereby dismissed due to non-prosecution.

Let plain copy be given to the parties, free of cost, as per CPR.
