21-09-2015 - The reasons for delay in disposal of this appeal can be seen from the order sheet.
- Inspite of fixing this case for passing ex-parte order, nobody appears for the complainant/respondent.
- On being satisfied with the grounds, the delay of about 42 days in filing this appeal is condoned.
- According to the complainant – appellant, she requested the O.P. – appellant to send her pension at her native place but it was not done.
- According to the appellant, the complainant made the said prayer after lapse of 12 years.
- It appears that R-2 – Regional Commissioner, Coal Mines Provident Fund Organization, D-1, Dhanbad, has filed a written statement/written argument, interalia stating therein as follows-
“8. That subsequently, the corrected copy of the bank pass book was submitted by the complainant, which was received by the O.P. on 13.03.2014 and immediately her arrear of family pension till March 2011 was calculated, amounting to Rs. 23,852/- and cheque of said amount was sent to the complainant’s bank, i.e. SBI Maunath Bhanjan Branch, P.O. Sahadatpura, Dist. Mau, (U.P.) vide cheque no. 020906, dated 26.03.2014.
9. That it is further stated and submitted that the arrear of the complainant from April, 2011 to February, 2014, (@ Rs. 164.50) is being released in the Family Pension addition list of March, 2014 for crediting tin complainant’s S.B A/c No. 31642413305 of SBI Maunath Bhanjan Branch.”
- In view of the aforesaid position, nothing further remains.
It appears that there were latches on the part of the complainant also. However, as her grievance has now been redressed, the order directing the appellant to pay Rs. 2,000/- as compensation and Rs. 1,000/- as litigation cost is set aside.
With this, the appeal stands disposed off.
