Final Order / Judgement

Per Shri B.A.Shaikh, Hon’ble Presiding Member.

1.      Advocate Mr.Sachin Zoting is present for the appellant. On last date he filed pursis stating therein that the respondent in appeal/original complainant has withdrawn her case pending before Additional District Consumer Forum as there is amicable settlement  in between both the parties due to full and final settlement of her claim. Today advocate Mr.Zoting submitted that permission may be granted to withdraw this appeal in view of the full and final settlement of the dispute in between both the parties. In view of the aforesaid submission and pursis filed on record, permission is granted to withdraw the appeal. Advocate Mr.Zoting submitted that permission may be granted to withdraw statutory amount of Rs.25,000/- deposited by the appellant with the Additional District Forum Nagpur as per receipt dated 15/12/2016. We find that as the dispute has been already settled in between both the parties and the execution application has been already withdrawn by the original complaint, the appellant is entitled to get refund of statutory amount of Rs.25,000/- deposited with the Additional District Forum as required for filing of appeal. The appellant shall move appropriate application to the said Forum for the same and the said Forum after verification of the record shall pass appropriate order on that application. Accordingly the appeal is dismissed as withdrawn. The copy of this order be furnished to both parties free of cost.
