The appeal is directed against the judgment and order dated 03.02.2014 passed by the District Forum, Haridwar, wherein the District Forum has directed the opposite party No. 1 to pay the complainant a sum of Rs. 8,000/- cost of the machine and Rs. 2,000/- as compensation and a penalty of Rs. 2,00,000/- to be paid by the opposite party No. 2 as fine.
Appellant and respondent No. 1 have filed joint application for compromise and requested that the appeal be decided in terms of compromise and the impugned order dated 03.02.2014 passed by the District Forum, Haridwar be modified accordingly.
Sh. Arun Uniyal, learned counsel for the appellant and Sh. Anuj Sharma, learned counsel for respondent No. 2 are present.
Sh. Harish Kumar, husband and authorized representative of respondent No. 1 is also present and he has been identified by Sh. Arun Uniyal, Advocate.
Before this Commission a bank draft of Rs. 14,000/- has been received by Sh. Harish Kumar, husband and authorized representative of respondent No. 1 and he undertake to return the old machine to the appellant-L.G. Electronics India Pvt. Ltd. within a week.
In view of the said compromise, the appeal is partly allowed and penalty levied on respondent No. 2 is waived. Order is modified accordingly.
Since, the appeal has been decided in terms of compromise. Therefore, the compromise application shall form part of the order.
