Heard on application for condonation of delay.

Considering the facts mentioned in the application seeking condonation of delay u/s 5 of the Limitation Act and arguments advanced by the learned counsel for the appellant Mr.Sandeep Sharma and specially considering the covid-19 pandemic situation, the delay of 38 days in filing this appeal is condoned subject to objection of respondent.

Learned counsel for the appellant Mr.Sandeep Sharma filed an application for withdrawal of this appeal. He submits that appellant decided to comply the impugned judgment dated 11.1.2021 passed by the learned DCC Jaipur 4^th Jaipur in Complaint Case No.73/2018 (Smt.Neena Singh Vs. Rajasthan Housing Board & ors.) therefore, appellants want to withdraw this appeal. He submits that there is no malafides in filing this appeal therefore, the appellants may be permitted to withdraw the same.

Since appeal is at initial stage and appellants want to withdraw the same therefore, application is allowed and this appeal is dismissed as withdrawn.
