Perused. Considered the Misc. Application No.MA/305/2023 filed on 12/09/2023 along with its objection.

It appears that the complainant/petitioner has prayed in the Misc. Application the substantive prayer which was prayed by her in the complaint case.  Such substantive prayer will be adjudicated on the touch stone of the evidence of the parties to the case and it cannot be allowed on the basis of Misc. Application.

Therefore, the Misc. Application dated 12/09/2023 being misconceived stands dismissed on contest but without cost.
