          Advocate for complainant files memo to return the complaint and permit him to file it before District Commission. 

In view of decision rendered by the Hon’ble National Consumer Commission, this Commission has no jurisdiction as the amount paid towards purchase of property is Rs.20.00 lakhs which is below pecuniary jurisdiction of this Commission and District Commission has jurisdiction.  Whereas District Commission without considering the amount paid by the complainant has returned the complaint, which according to us is not legal.  Hence, complaint is returned to the complainant.  The District Commission is directed to accept the complaint whenever the complainant presents it and restore the complaint in its original number and proceed as per Consumer Protection Act and dispose the matter on merits expeditiously. 

          Court fee paid before this Commission is sufficient to entertain the complaint.
