Learned counsel Smt. Shashi Yogeshwar alongwith an associate Smt. Jyotsana Pant for the revisionists has appeared.

A perusal of the revision has revealed that this revision has been filed on behalf of the Electricity Department against the opposite party – complainant for setting aside the impugned ex-parte order dated 20.03.2020 whereby the revisionists – opposite parties were ordered to continue the electricity connection bearing No. 6910437129619 immediately.

Having been aggrieved by the impugned order, the present revision has been filed on behalf of the Electricity Department challenging the impugned order with the prayer to set aside the same.

During the course of hearing, it is apprised by the counsel for the revisionists that the consumer complaint has been dismissed by the District Commission, therefore, when the complaint case is not pending, therefore, the revision is not maintainable.

The complaint case filed in the District Commission has already been dismissed and the impugned ex-parte order is an ex-parte order without giving opportunity of hearing to the revisionists / opposite parties. 

We are of the view that the ex-parte order is passed without merits as well as the consumer complaint has already been dismissed, therefore, there is no relevancy to continue the revision.  Hence, the revision petition has become infructuous.

Accordingly, the revision petition is hereby dismissed on account of being infructuous.  

File be consigned to the record room alongwith copy of this order.

A copy of this order be sent to the District Commission concerned for perusal and necessary information.
