Final Order / Judgement

Heard Ms. Aanupamaa Gautam, learned counsel for the applicant through video conferencing.

This miscellaneous application has been filed by the applicant for releasing the amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only), which was deposited by the applicant towards mandatory deposit while filing First Appeal No. 16 of 2013; M/s Ganpati Builders Vs. Smt. Madhu Arora and another.

Perusal of record reveals that the aforesaid appeal filed by the applicant was allowed by this Commission vide judgment and order dated 24.01.2013 and the judgment and order dated 20.03.2012 passed by the District Commission was set aside and the case was remanded back to the District Commission for decision afresh in accordance with law.

In view of the fact that the appeal filed by the applicant was allowed by this Commission and the judgment and order passed by the District Commission was set aside, there appears sufficient ground for allowing this miscellaneous application and releasing the amount in favour of the applicant.

Accordingly, the miscellaneous application is allowed and the aforesaid amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only) deposited by the applicant at the time of filing the appeal, be released in favour of the applicant.
