JUDGMENT
The facts of the complaint in brief is that the complainant has paid total amount of Rs.1,18,000/- to the OP in various dates from 2006 to 2014 for smooth running of SHG and supply of nutrition chatua food packets and the OP assured to pay Rs.1,20,640/- and the total amount is to be paid by the OP is Rs.2,32,400/-but till yet the OP has not paid the said amount to the complainant. Due to non payment of invested amount by the OP, the complainant suffered mental agony and financial loss. Hence prayed to direct the OP to pay the total amount of Rs.2,32,400/- along with interest and compensation of Rs.50,000/- with litigation charges and direct the OP 2 to stop the payment from the office till payment to the complainant. Hence, this complaint.
Being noticed by this forum the opposite party No.1 remained silent and did not turn up to file any written version. The OP 2 appeared and filed written version stating therein that the complainant agreed to withdraw the case against them. Hence they pray to dismiss the case against the Op 2. In absence of any written version from the opposite party No.1 we proceeded the matter exparte and believed the allegations of the complainant and hence, we passed the order and dispose of the matter with the following directions.
ORDER
The opposite party No.1 is directed to pay amount of the complainant with interest i.e. Rs.2,32,400/- and Rs.10,000/-towards mental agony and cost of Rs.500/- to the complainant within one month from the date of receipt of this order. The case against the OP 2 is dismissed as there is no iota of evidence against them. In the instance the OP 2 is directed to suggest the Op 1 for payment failing which the O.P is liable to pay interest @ 12% p.a. on the above awarded amount till the date of payment.
