None appears on behalf of either of the parties.

       Pursuant to order dated 29.1.2018 application for condonation of delay in filing the appeal was allowed subject to payment of cost of Rs.30,000/- by the appellant to the respondent.

       It appears from order dated 25.10.2018 passed in Misc. Case No. 990 of 2018 that Bank Draft for Rs.30,000/- renewed by the Bank on 24.9.2018 was filed by the appellant/petitioner to be received by the respondent/complainant towards cost and the matter was directed to be listed on 28.11.23018 for payment of cost and hearing on the point of admission. None appeared on behalf of either of the parties on 28.11.2018, 2.1.2019, 10.1.2019 and 22.1.2019 when the matter was last posted for payment of cost and hearing on the point of admission. In the meanwhile the validity period of the Draft filed on behalf of the appellant has expired. Since there is none appearance on behalf of the appellant on several dates, it is presumed that the appellant is not interested to pursue the appeal. Therefore, the appeal is dismissed for non-prosecution.
