Ld. Counsel Mr. Tarun Kumar Mishra appeared for appellant. Ld. Counsel Mr. J.B.S. Rathore appeared for respondent no.1.

None appeared for respondent no.2.

Respondent no.2 is a formal party.

Appellant and respondent no.1 has filed application for disposal of appeal in terms of compromise.

Application has been signed by ld. Counsel for appellant and ld. Counsel for respondent no.1.

Ld. Counsel for the parties supported conditions of compromise mentioned in paragraphs 1 to 4 of the application. Application containing terms and conditions of compromise was signed by ld. Counsel for the parties before Commission. Thereafter, I have verified the compromise today.

In view of above submission made by ld. counsel for the parties as well as application moved by the parties, appeal is decided in terms of application dated 19.7.2019.

The said application shall be part of this order.

Rs. 25,000.00 deposited under section 15 of the consumer Protection Act in this appeal shall be remitted to District Forum alongwith interest accrued for disposal in terms of above application/compromise.  

The amount deposited before the District Consumer Forum in compliance of interim order passed in this appeal shall be released to respondent/complainant alongwith interest accrued in terms of above application/compromise.
