Complainant through Mr. Sudip Kr. Das, the Ld. Advocate, O.P. No. 7 through Mr. R. K. Choumal, the Ld. Advocate and O.P. No. 10 through Mr. Proloy Kr. Roy, the Ld. Advocate are present.  In course of argument there was a talk of settlement between the Complainant and O.P. No. 10 against whom the main claim of the Complainant is involved.  The Complainant and his Ld. Advocate is present.  O.P. No. 10 is represented by Ld. Advocate.  O.P. No. 10 has filed an application for compromise of refund of identified amounts as indicated in the application in terms of the said settlement.

 

In view of the said development as the matter has been settled between the parties who were contesting, we have not entered into merit of the matter and the complaint case is disposed with the following direction.

 

O.P. No. 10 will pay a sum of Rs. 6,74,000/- to the Complainant as also a sum of Rs. 3,90,000 towards interest @ 8% p.a. on the aforesaid amount upto 31.12.2009.  Respondent No. 10 will also pay further Rs. 2,00,000/- as compensation to the Complainant.  The entire amount as indicated hereinabove will be paid by O.P. No. 10 to the Complainant within a period of 90 days from the date of this order and in default thereof O.P. No. 10 will pay further interest @ 9% p.a. on the total amount due for the period of default.  Complaint is disposed of on the aforesaid terms.  Complainant admits that there is no claim against the other O.Ps and complaint is dismissed against the other O.Ps.
