Member : Smt. Jhumki Saha. F I N A L O R D E R 1. The instant case was filed by complainants U/S 12 of the C.P. Act, 1986 wherein the complainants have prayed for direction upon the o.ps. to install the lift upto 4th floor of the schedule property and to pay compensation to the tune of Rs. 1 lakh with litigation costs as the O.Ps. completely violated the 3rd schedule of the deed of agreement ( deed no. 04220 of 2011, page no. 15 ) and did not provide the lift facility causing tremendous hardship to the flat owners. Hence the case. 2. Notices were sent to the O.Ps. but it returned with the postal endorsement ‘Not known’. But the lawyer notice dated 15-07-2013 sent at the same address was served upon the O.Ps. giving the indication that the O.Ps. manipulated in refusing the notice only to create hardship to the complainants. 3. The only point requires determination - whether the complainants as consumers are entitled to the relief as prayed for ? DECISION WITH REASONS : 4. . The complainants are very much in possession of the suit flats after execution of the sale deed. On repeated requests the O.Ps. turned a deaf ear and the lift facility was not provided in violation of the agreement. Therefore, it is a fit case where the prayer of the complainant shall be allowed. Hence, O R D E R E D That the C. C. Case No. 359 of 2013 ( HDF 359 of 2013 ) be and the same is allowed ex parte as against the O.Ps. with costs. The O.Ps. be directed to install the lift up to the 4th floor in the schedule property within 60 days from the date of this order. The complainants are also entitled to a litigation cost of Rs. 5,000/- from the O.Ps. No order as to compensation.
