Sri Aalok Kumar Srivastava, learned Counsel for the revisionist appeared.

None appeared for opposite party. Notice has been sent to opposite party through registered post on 18-11-2016. Same has not been returned unserved. Service of notice is held sufficient on opposite party.

I have heard learned Counsel for the revisionist and perused impugned order dated 20-01-2016 passed by District Consumer Forum, Deoria in Complaint Case No. 115/2010 Smt. Indrawati Shahi V/s Branch Manager, Sahara India Pariwar and others.

Vide impugned order dated 20-01-2016 passed in above complaint the

District Consumer Forum has finally disposed of application 20 Kha moved by revisionist who is opposite party in said complaint subject to condition that the revisionist/opposite party may make his submission regarding objection raised in application 20 Kha at the time of final hearing.

Vide application 20 Kha moved before District Consumer Forum the revisionist has submitted that arbitration award has already been given regarding dispute in complaint. As such the complaint is not maintainable. The District Consumer Forum has not passed final order on this subject and the issue is open for determination by District Consumer Forum.

The revision is disposed of finally with direction to the District Consumer Forum to pass appropriate order in accordance with law.

Let copy of this order be made available to the parties within 15 days positively as per rules.
