Final Order / Judgement

Hon'ble Shri Ajeya Matilal, Presiding Member

The Learned Advocate for the respondent is present.

None appears for the appellants on repeated calls.

It is now 1 p.m.

It appears from the order No. 23 dated 08.08.2022 and Order No. 24 dated 10.03.2023 that the appellant was absent without any steps on these days

Today is fixed for hearing of the appeal as a special chance.

Today also the appellant is absent without any steps.

Being aggrieved by and dissatisfied with the order dated 15.05.2013 passed by the Learned DCDRF, Alipore, South 24- Pgns. allowing CC case No. 199 of 2011 on contest against the O.P Nos. 1 and 1(a),  ex parte against other OPs with cost of Rs. 5000/- to be paid by the OP No. 1, the appellants preferred this appeal.

Perused the impugned judgement. We do not find any illegality in the same.

Accordingly, the appeal being FA No. 1317/2013 is dismissed.

The impugned order is upheld.

There shall be no order as to the costs. Order of stay if there is any in connection with the present appeal stands vacated.
