Learned Counsel Mr. A.K. Samal  is present on behalf of the Appellant and filed a memo as follows:-

                   "That the Advocate for the Appellant could not be able to get necessary instructions from his client (appellant) to be able to argue the matter before this Hon'ble Commission.

                   Under such circumstances, the Advocate for the appellant has no other alternative than to withdraw his power from this case."

                   Memo be kept in record.

                   In view of above facts, Office is directed to delete the name of learned Counsel Mr. A.K. Samal from the case records as well as cause list on behalf of the Appellant.

                   On perusal of records, it is found that Appellant was absent on dt.20-03-2023 and 04-04-2023

                   In pursuance to order dt.04-04-2023, fresh notice was issued to the Appellant on dt. 17-04-2023.

                   In-spite of notice dt. 17-04-2023, Appellant was absent on dt.22-05-2023 and dt.08-06-2023 and to-day learned Counsel for the Appellant filed no instruction memo.

                            Hence, the appeal is dismissed for non-prosecution.

                            Send back the DFR.
