ORDER NO. 3 DT. 18.02.09

         

The record is placed for passing necessary orders on the point of admission of the present Revisional Application.  On perusal of the impugned order, vide order no. 7 dt. 14.5.2008, we find that the Ld. Calcutta District Forum, Unit-I, passed the impugned order in CDF-1/Case no. 299/2007 thereby allowing he claim of the complainant and the Ops were directed to pay Rs. 2,00,000/- together with compensation and litigation cost.

         

Firstly, we find that the certified copy of the impugned order was supplied on 27.11.08 and the present Revisional Application has been filed on 18.12.08.  In the absence of other relevant and connected particulars viz. date of application for certified copy, we are not in a position to consider the present Revisional Application on the point of limitation, etc.   Besides that we find that the present Revisional Application has been filed against the impugned order which has finally disposed of the complaint case.  If that be the position we do not think that any Revisional Application of the present nature lies against the finally disposed of order.  Accordingly we are not in a position to admit the Revisional Application which is accordingly stands  dismissed.  However, considering the fact that somehow or other the Revisionist is being aggrieved by the impugned order we give liberty to the Revisionist to file appropriate application before the appropriate forum after observing all the legal formalities like limitation, etc.

         

The Revisional Application is thus disposed of.
