| ORDER | ORDER NO. 11 DT. 18.3.11HON’BLE JUSTICE MR. P.K.SAMANTA, PRESIDENT DHr through Mr. B.Prasad, Ld. Advocate. JDr. No. 6 is present through Mr. P.K.Giri, who files Vokalatnama and a put-up petition. On the prayer of the Ld. Advocates for both the parties the Execution Case being EA No. 1 of 2010 is treated as on day’s list for final disposal as a special case. Mr. P.K.Giri, Ld. Advocate, appears on behalf of Smt. Bela Banerjee, JDr No. 6. It is not in dispute that the other JDrs have respectively satisfied the decree. Said Smt. Bela Banerjee has today paid Rs. 33,360/- towards full and final satisfaction of the decree/order dt. 9.12.09 passed in SC Case No. CC/08/52 to Mr. B.Prasad, Ld. Advocate for the DHr. Mr. Prasad has produced a photocopy of the receipt showing payment of the aforesaid amount to him on behalf of the DHr. The said receipt be kept on record. Mr. Prasad further submits that in view of such payment the decree stands satisfied on the part of Smt. Bela Banerjee. In view of such satisfaction of the decree Mr. Prasad on behalf of DHr submits that the execution proceeding, therefore, should be disposed of on full satisfaction of the decree. In view of such submission, it is recorded that the execution case shall stand disposed of as the decree has been fully and finally satisfied in the meantime. The order dt. 19.1.2010 passed by this Commission by directing the Officer-in-Charge, Phoolbagan P.S. to cause presence of Smt. Bela Banerjee shall stand recalled. The Officer-in-Charge of the Phoolbagan P.S. be communicated with this order by the office of this Commission immediately. | |
