HON’BLE JUSTICE SRI A. CHAKRABARTI, PRESIDENT.

 

Appellant through Mr. H. Bramhachari, the Ld. Advocate and Respondent No. 2 through Mr. S. Nayak, the Ld. Advocate are present.  The Ld. Advocate for private Respondent is not present.  Mr. Bramhachari informs that according to the arrangements suggested on the last date of hearing the private Respondent has already removed wires from the roof of the Appellant by affixing wooden poles and, therefore, the apprehension of the Appellant is no more there.  We have also considered the judgement under appeal.  The said judgement only gives direction upon the C.E.S.C. and in compliance of that C.E.S.C. already effected the connection upto the common meter box.  From the said meter box the line was drawn by the private Respondent which caused grievance of the Appellant resulting in the filing of present appeal.

 

With regard to the direction given by the trial Forum there cannot be any grievance as the act of the C.E.S.C. does not affect any right of the Appellant.  Therefore, there is no reason for interference on the present appeal but the grievance of the Appellant since having been removed we do no find any further order is required and the appeal is disposed of.
