Ld. Counsels for both sides are present.
Being aggrieved by and dissatisfied with the Judgment dated 25.03.2021, passed by DCDRC, Chinsurah, Hooghly in CC/9/2018 allowing the case with a direction upon Opposite Parties Nos.1 & 2 to transfer and register the Deed of Conveyance in respect of the scheduled flat within two months from the date of Judgment, the Appellant prefers this Appeal.
Heard submission of the Ld. Counsels for both sides. Considered.
It is admitted position that consideration money has already been paid to the OPs/Appellant by the Complainant/Respondent and also put to the possession of the scheduled flat. But the grievance of the Complainant/Respondent was that no Deed of Conveyance was executed and registered in her favour.
We are of the view that an appropriate order should be passed.
Hence, it is
ORDERED
Appeal being No.97 of 2022 is disposed of.
Parties concerned are directed to execute and register a Deed of Conveyance in respect of the scheduled flat within 45 days from the date of this order.
The remaining portion of the impugned order regarding payment of compensation and costs remains unaltered.
Order of interim stay, if there is any, stands vacated.
Let a copy of this order be sent to the Court Below. Copy of the order be made available to the parties free of costs.
