ORDER

Per Shri S.R. Khanzode, Hon’ble Presiding Judicial Member

          This application is filed to restore the appeal which stood dismissed for default by this Commission on 06/07/2010. 

          We heard Mr.Deepak Sharma, Advocate for the applicant.

          As mentioned in Para 4 of the restoration application, Advocate on record Mr.Dinesh Gupta appointed another Advocate to appear in the said appeal and pray for an appropriate adjournment after making requisite prayer to the Hon’ble Lordship.  Today, it is submitted before us by Learned Counsel for the applicant that he was down with Malaria and therefore, he could not attend the matter and under the circumstances, matter be restored back. 

          Referring to the ground mentioned, it is an Associate and not the Advocate Mr.Dinesh Gupta was ill.  Besides, that once Learned Counsel appointed another lawyer, ground of his own illness became irrelevant.  There is no apparent or sufficient reason to recall the order and restore the appeal back to file.  Hence, the order :-

                   -: ORDER :-

1.       Misc. Application No.365/2010 stands dismissed.

2.       Copies of the order be furnished to the parties.
