Learned counsel Sh. Gaurav Verma for the appellants has appeared through video conferencing.
An application has been submitted on behalf of the appellants alleging that a compromise has been arrived at between the parties to the appeal, hence the appeal shall be decided as per the compromise.
On record, the appellants have submitted a compromise (paper No. 39) alongwith receipts.
As the compromise has been arrived at between the parties and as per the compromise, the matter has been settled during the proceedings of execution case No. 05 of 2017; Smt. Neha vs. Link Utsav and others and Rs. 20,000/- has been paid to the respondent No. 1 by the appellants.
The compromise filed on record (paper No. 39) is not signed by the respondent No. 1, but it is crystal clear that the dispute between the parties has been settled; now there is no dispute between the parties and the appeal has become infructuous.
As per the application (paper No. 43), the appeal is hereby dismissed. No order as to costs.
The statutory amount Rs. 22,000/- deposited by the appellants before the State Commission or the District Commission be released in favour of the appellants, as per law.
A copy of the order be sent to the concerned District Commission for perusal and necessary compliance.
File be consigned to the record room alongwith the copy of the order.
