The adv. for the appellant has filed an application for condonation of delay of 45 days in filing present appeal and has claimed that the delay is caused because of the heirarchical manner of corporate decision making process which included the translation of Forum order, legal opinion, and then final drafting and filing an appeal which consumed the time and resulted in the unintentional delay of 45 days which may be condoned in view of the strong case of the appellant. It is countered by the resp submitting that the appellant has not given, the day today reasons of the delay and has causally explained the delay which does not indicate his sincerity as well  urgency, in filing the appeal. As the delay is two long, it may  not be condoned.

I heard both the advocates, I do find that the appellant appears to have taken the time in either translating the order and taking opinions on the grounds of administrative delay which I do not find justiable in view of the grounds raised by the respondents. The appellant is a professional institution with a well defined system for taking cogent and fast steps and cannot be excused for such delay and hence I prefer not to condone the delay and thus reject the application. Hence the application is rejected. Consequently the appeal is dismissed.
