None for appellant is present. Its counsel Shri. Vipin Kulkarni is also absent. On 27/11/12 notice on delay condonation was issued to the Respondent but it returned back with postal remark “incorrect address”. Hence the counsel for the appellant was directed to submit correct address of the Respondent and take steps to issue notice on the correct address. However, the same direction is not complied. However, on last date, when the matter was recalled, Adv. Shri.Kulkarni for the appellant appeared and submitted that there is likelihood of settlement between the parties and sought adjournment. Therefore, on the last date, the matter was adjourned till today by way of last chance, but the appellant did not turn up. Hence the appeal deserves to be dismissed in default. Hence it be recalled at 3.00 p.m.
