Present:       Sh. Sanjeev Sharma, Advocate for complainant.

                   Sh. Kunal Juneja, Advocate for the opposite party No. 3.

                   Opposite Party No. 1 & 2 exparte.

                   File put up before National Lok Adalat. Heard. Ld. counsel for the opposite party No. 3 made a statement that their full and final settlement has been effected with the complainant in Rs.105000/-(Rupees one lac five thousand only) and the same will be paid to the complainant within 45 days. It is further submitted that product should not be physically damaged or liquefied. Complainant should return the product alongwith accessories to the customer care on or before taking the payment.

                   Ld. counsel for the complainant also made a statement that he agrees with the above statement and the handset is already with the service centre. It is further submitted that he has no objection to decide the case accordingly.

          In view of the statements made above by both the parties, opposite party No.3 is directed to pay the alleged amount of Rs.105000/-(Rupees one lac five thousand only) to the complainant within 45 days from today, failing which opposite party No.1 shall be liable to pay interest @ 9% per annum on the alleged amount from today i.e. 08.09.20203 till its realization to the complainant. Parties shall be bound by their respective statements. Complaint is disposed of accordingly being settled before Lok Adalat. Copy of this order be supplied to the parties free of cost.

          File be consigned to the record room after due compliance.
