Shri J. R. Gupta, learned counsel for the appellant.

Shri Satish Sahu, learned counsel for the respondent.

As per Shri Justice Shantanu S. Kemkar :

Heard learned counsel for parties on IA-1, application for condonation of delay in filing appeal.

This appeal is directed against the part of the order dated 03.03.2012 passed by the District Consumer Disputes Redressal Forum, Rewa (for short ‘Forum’) in C.C.No.27/2011 whereby the Forum has as per paragraph 7 (c) of the impugned order has directed the appellant to pay compensation of Rs.3000/- and costs Rs.2,000/- jointly and severally with the opposite party no.2 with 7% simple interest from the date of filing of complaint till payment.

2.                     The appeal is barred by eight months and fourteen days. On going through the reasons stated in the application for condonation of delay we find that the delay has not been satisfactorily explained.  No case is made out to condone the huge delay of more than eight months. In the circumstances, we decline to condone the delay. The application is dismissed. As a result, the appeal is also dismissed

3.                     The appellant has not deposited the cost amount of Rs.500/- imposed on 07.07.2015, same is recoverable from the appellant in execution proceedings which are already pending before the Forum.
