This Order is intended to dispose of the complaint which is in line with other facsimile complaints already disposed of by this Commission.

Read in juxtapose of the pleadings and counter pleadings of the parties which are always by and large similar, we therefore, dispense with any elaborated judgment with discussion and move on to dispose of the case by this concise Order on the point for adjudication, which appears to rest on the precise issue as to whether the opp. party was obligated to provide free carry bag in purchase of commodity from its retail store?

Complainant during his sojourn in Kolkata from 07.04.2023 to 14.04.2023 visited the opp. party Store on 12.04.2023 and purchased cloths worth Rs.4,875/-. The cashier of the opp. party store handed over the cloths in a carry bag worth Rs.25/- which was included in the total bill vide Ext-1, Tax Invoice No.FRBS12923503906 of the opp. party Store.

Per contra to the plea of the complainant for free carry bag, the stand of opp. party has been that a carry bag always comes with a price together with the unrebutted point that there is no law prohibiting sale of carry bag by Stores like the opp. party.

We are constrained to cut short our proceeding ahead with any further appreciation of facts, finding at the outset that the carry bag in question has not been exhibited before the Commission which thus, obviates a deep scrutiny into the merit of the complaint.  The case appears to have been nipped in the bud and unsafe for fair adjudication.

In view of above, the case accordingly stands dismissed.
