- The Brief fact of the Complainant is that on dtd. 12.11.2023, the Complainant booked one percel/consignment in the service station of the OP to send the same to Anoop Road Carriers Add 9JSPI Parking Transpotrnagar, Raigarh. The content of the percel/consignment were two number of vehicle challan in Original worth of Rs.35,000/- and other related documents. The Complainant has paid Rs. 80/- as service charges to the OP. After 10 days on dtd. 22.11.2023, the Complainant visited the service point of the OP and inquired about the delivery of the parcel/consignment but the OP could not give any information regarding the parcel but requested him to want for some days. The Complainant made several correspondences with the OP and requested for early delivery of the consignment in view of the facts that, the consignment were containing important original vehicle challan along with documents and in spite of the same the consignment sent have not been delivered. The OP did not deliver the consignments in the respective destination and to the consignee thereby the OP are not only deficient in rendering services to the Complainant but also has adopted unfair trade practice by way of sitting over the matter.

- After perusing the case record and evidences, it is observed that the OP did not deliver the consignments in the respective destination although received Rs. 80/- from the Complainant as service charges for which the Complainant sustained financial loss and has also suffered mental agony for non-delivery of the consignments to the consignee. So deficiency in service found against the OP. Accordingly it is ordered.
ORDER
The O.P is directed to pay an amount of Rs. 35,000/- towards cost of the original vehicle challan, Rs. 50,000/- towards damage suffered by the Complainant and towards physical strain and mental agony suffered by the Complainant as compensation and Rs. 10,000/- towards cost of litigation expenses to the Complainant within 30 days from the date of order, failing which the amount will carry with 9% interest per annum till realization to the complainant.
Order pronounced in the open Court today on 22nd day of July, 2024.
