On 04.09.2014 the present complaint came to be admitted and notices were ordered to be issued to the OPs.  OP-3 despite service of notice remained absent and was placed ex-parte.  OP-4 entered appearance through his advocate.  OP-2 was reported to have vacated the address.  Since, no steps were taken against OP-2 for service of notice, case as against OP-2 came to be dismissed.  OP-4 filed his version on 23.12.2015 and on the same day the complainant was called upon to file his affidavit evidence.  However, the complainant thereafter never appeared before the Forum and failed to file his affidavit evidence.  The order sheet discloses that, the complainant and his advocate have remained absent continuously since after 27.11.2014.  The complainant despite being given sufficient time and opportunity failed to prosecute the complaint by filing his affidavit evidence.  It appears that, the complainant has no interest in prosecuting the complaint.  Therefore, the complaint is dismissed for non prosecution.
