Appellant purchased a car for the use of its Managing Director.  The tyre burst 13 times.  Alleging that the car supplied was defective, appellant filed the complaint before the State Commission which has been dismissed as being ‘not maintainable’ as the car had been purchased for a ‘Commercial Purpose’, i.e., for the use of the Managing Director of the appellant which is a private limited company.

Order passed by the State Commission is in line with the judgment of this Commission in “FA 723 of 2006 titled as General Motors India Pvt. Ltd. Vs. G. S. Fertilizers (P) Ltd. decided on 07.02.2013” wherein in the similar facts we have taken a similar view.  No ground for interference is made out.  Dismissed.
