Today is fixed for hearing argument.

On scrutiny of the record it appears that MA being no. 104/2022 which was filed by the complainant seeking amendment of the complaint is still pending disposal. As such, the case is taken off from the stage of hearing argument.

The MA being no. 104/2022 is taken up for hearing. Heard the Ld. Advocate on both sides. The complainant has sought for rectification of date (year) for cash payment of Rs. 50,000/- as noted in para 10. It is submitted by the Ld. Advocate of the complainant that due to typographical mistake in place of ’10.01.2020 ’the date of payment has been written as 10.01.2021’. It is submitted by the Ld. Advocate appearing for the OPs that the nature and character of the case would be changed if such amendment is allowed. But we do not subscribe to the view expressed by the Ld. Advocate of the OPs. We consider the amendment sought for is most formal in nature. The need for such amendment has arisen due to clerical mistake.

The prayer for MA being no.104/2022 is allowed and disposed of.

The Ld. Advocate of the complainant is directed to file amendment complaint by 22.11.2022.
