Final Order / Judgement

 

         Mr S.Swain, learned counsel files Vakalatnama on behalf of the OP which is accepted and kept on record.

2.      Learned counsel for the petitioner submits to dispense with the original copy of interim order dated 25.5.2022 passed by the learned District Commission, Bhadrak  on the ground that the copy of the order has been filed in R.P.No.33/22 which was disposed of. True copy is filed. Required defect is ignored. Copy of the  revision petition be served on the learned counsel for the O.P.

3.      Heard learned counsels for both sides on the revision petition.

4.      Learned counsel for the petitioner submits that the matter was not heard in his presence and again ex parte order has been passed by the learned District Forum,Bhadrak. He pressed the order dt.25.05.2022  where it is mentioned that the O.Ps neglected  to comply the order of the District Commission but they have not  received the summon.

5.      Learned counsel for complainant in this petition submitted that as per earlier interim order, he was ready to  deposit the EMI  but the present petitioner/ O.P in the complaint case did not receive the same.

6.      Considered the submission of both counsels and perused the interim order dt.25.05.2022.  We are not inclined to interfere with impugned order. Hence, we direct the complainant to comply the impugned order within five days by depositing Rs.1,50,000/- along with stock yard charges of Rs.15,000/- with the petitioner within five days. After receiving the same, the vehicle would be released forthwith by the petitioner. In the event of compliance of order, coercive order passed by learned District Commission till date shall not be carried out.

         Revision petition is disposed of accordingly.
