- The complainant has filed the instant complaint under Section 12 of the Consumer Protection Act 1986 as amended up to date inter alia pleading therein that on 24/07/2013 he visited Sir Ganga Ram Hospital for having a cap on 5th tooth of the left side. X-ray was taken and he was advised by Dr. Sunita that he had to undergo RCT Treatment. On advise of Dr. Sunita complainant spent Rs. 2563/- on x-ray and a date was given as 03/08/2013.
On 11/09/2013 complainant visited OP Hospital where an incompetent Doctor who attended him grinded his tooth due to which it was not possible to have Cap on it.
On 21/09/2013 complainant visited Dental Department of St. Stephens Hospital to take opinion of a competent Doctor.He was told by a doctor that a Cap could not be placed on his tooth and that implant had to be fixed after extraction.
On 23/09/2013 complainant visited Dental Department of Maulana Azad Hospital where he was again told by Doctor that capping of tooth was not possible and extraction and implant will cost him Rs. 20,000/-.On 30/09/2013 complainant visited Dental Unit of OP Hospital where a Doctor told him that his tooth no. 5 is weak and he can have a bridge over tooth no. 4 and 5.
Complainant sought refund of Rs. 2070/- from OP but he was not heard.Hence, the instant complaint seeking direction to OP to pay him Rs. 1 Lac as compensation for causing damage to his tooth.

It is further submitted that he again came on 21/08/2013 RCT was started in +5 and completed on 24/08/2013.
It is further stated that again on 31/08/2013 RCT Post Obturation filling was completed and patient was advised a crown and he preferred a metal crown.
It is further stated that again on 11/09/2013 crown cutting was done for metal crown.Patient was recalled on 14/09/2013 for cementing the crown.But he did not turn up.
On 30/09/2013 patient visited a different unit.Since time had elapsed he required a RCT in +4 also which had a faulty restoration.Hence they advised a joint crown for +4, 5.
7. Complainant has alleged that his tooth was damaged by excess grinding by an incompetent Doctor at OP Hospital. He has stated that he was also told by a doctor of St. Stephens Hospital (In Para 5 of the complaint) and Maulana Azad Hospital (Para 6 of the complaint) that capping of his tooth is not possible and fixing of implant after extraction had to be done at the cost of Rs. 20,000/-. Complainant has not placed any opinion of any doctor of St. Stephen’s Hospital or Maulana Azad Hospital as alleged by him in the complaint. He has not been able to prove that any damage was caused to his tooth by doctors of OP hospital on account of any negligence. Since no cause of action is made out against the OP Hospital for any negligence in treatment of the complainant, complaint is dismissed. A copy of the order be sent to concerned parties as per statutory requirement. File be consigned to record room.
