ORDER:

1.             Charanjit Singh, complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that he  invested an amount of Rs.50,000/-  with OPs  vide  FDR number SGN/002423  on  29.02.2012 for a period of 66 months at the rate of 13.40% per annum. The date of maturity of the FDR was 29.08.2017. After the maturity date, the complainant submitted  original FDR with Ops and fulfilled all the formalities for releasing the maturity amount.  Thereafter the complainant requested the OPs so many times to release the  maturity amount but they did not release the maturity amount. Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:- 

i)      OPs be directed to pay Rs.1,00,000/- along with interest @18% per annum till payment,

ii)     OPs be directed to pay to the complainant a sum of Rs.50,000/- on account mental agony and harassment and Rs. 11000/- as litigation expenses.

2.             Notices were sent to the OPs but none has appeared for the OPs despite service. As such OPs were proceeded exparte.

3.             The complainant has tendered documents Ex.C-1 to Ex.C-3 and closed evidence.

4.             From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that it is the case of the complainant that he  invested an amount of Rs.50,000/-  with OPs  vide  FDR number SGN/002423  on  29.02.2012 for a period of 66 months at the rate of 13.40% per annum. The date of maturity of all the FDR was 29.08.2017  which is evident from copy of FDR Ex.C-1.  After the due date of said FDR the complainant submitted original FDR and fulfilled all the formalities for releasing the maturity amount but the OPs did not release the maturity amount till today. The complainant has also produced on record copy of receipt Ex.C-2. The OPs have not come forward to contest the case of the complainant rather they chosen to remain exparte.

5.             For the reasons recorded above, we allow the complaint and direct the OPs to pay to the complainant an amount of Rs.1,00,000/- alongwith interest @9% per annum from the date of filing of the complaint till realization. We further direct the OPs to pay to the complainant an amount of Rs.3500/- on account mental pain agony and harassment and Rs.1500/- as litigation expenses.       

6.             This order of ours shall be complied with within 60 days from the date of receipt of copy of the order. A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
