F I N A L O R D E R
- This is an application U/S 12 of the C.P. Act, 1986 filed by the petitioner, Shri Manoj Patra, praying for direction upon the o.ps., Silicon Project India Ltd. and others, to pay the matured sum of Rs. 16,200/- with interest till realization and to pay compensation of Rs. 50,000/- for, mental and financial harassment.
- The case of the petitioner is that he purchased one Agro Bond on periodical investment basis from the o.ps. who are registered companies under Company Act for a period of 12 months on 07.01.2013 and the bond to mature on 07.01.2014 and made payment of Rs. 14,400/-. On maturity of the bond on 07.01.2014 when he approached the o.ps. then they denied to make any payment which amounted to cheating. The petitioner went to the Consumer Affairs & Fair Business Practices and then came to this Forum for the above relief.
- The o.ps. though served with notice did not appear in the case and thus the case is heard ex parte against them.
4. The only point to be decided herein whether the petitioner is entitled to get reliefs as prayed for ?

In support of his case the petitioner filed the bond papers issued on 07.01.2013 with maturity date 07.01.2014 and other documents connected with the o.ps. and the oral as well as documentary evidences filed by the petitioner went unchallenged and there is nothing to disbelieve the case of the petitioner. The documents proved ex parte the fact is that o.p. received the money but did not pay the maturity amount which the petitioner is entitled.
In view of above, the case of the petitioner is liable to be allowed ex parte.
Court fee paid is correct.
Hence,
O R D E R E D
That the C. C. Case No. 37 of 2015 ( HDF 37 of 2015 ) be and the same is allowed ex parte against the O.Ps. without costs.
The petitioner is entitled to the sum of Rs. 16,200/- with interest from the date of maturity i.e., 07.01.2014 till realization @ 9% p.a. and also compensation for a sum of Rs. 10,000/- for physical and mental agony. The o.ps. are directed to make the above payment within 30 days from the date of this order failing the petitioner would be at liberty to put the order in execution as well as the above sum would carry interest @ 9% till realization.
Supply the copies of the order to the parties, as per rule.
