Appellant Mr G Rathi as well as his counsel Mr Sarda are absent. Adv.Mr R B Kalantri for the respondents is present. 

             The appellant is absent since long. Therefore, notice was issued to the appellant and respondents. In response to the notice, respondents through their counsel Mr Kalantri appeared today. However, nobody turned up for the appellant. As the report was not received on last date, the matter was adjourned till today to wait for report. But today also the appellant is absent. 

            On perusal of the office copy of the notice it reflects that it was issued on correct address of the appellant as given in the appeal memo. Therefore, it will have to be presumed that the appellant is served with notice. But he is absent. Therefore, appeal deserves to be dismissed in default.

              Accordingly, the appeal is dismissed in default.

              No order as to cost.

         Copy of this order be supplied to the parties.
