Learned counsel Mr. S. Mishra is present on behalf of the Appellant and filed a memo stating that as no cause of action survives at present, the appellant does not want to pursue the matter and prayed to pass necessary order.

In such fact of matter no cause of action survives in the present appeal and hence the appeal has become infructuous.

Hence the present appeal be treated as infructuous and disposed of accordingly.

Statutory amount may be refunded to the appellant on proper identification.
