O R D E R

 

RAM SINGH CHAUDHARY, JUDICIAL MEMBER:

 

Delay in filing the appeals are condoned for the reasons mentioned in the applications filed for condonation of delay.

2.      Vide this order above mentioned thirty appeals, bearing Nos.723 of 2018, F.A. No.724 of 2018, F.A. No.1078 of 2018 to 1103 of 2018, F.A. No.1136 of 2018 and F.A.1137 of 2018, will be disposed of, as said appeals are directed against orders passed by District Consumer Disputes Redressal Forum, Hisar (in short ‘District Forum’) on respective dates.

3.      Since there are thirty appeals   arising out of the common order passed by the learned District Forum, Hisar and since all the appeals bearing Nos.723 of 2018, F.A. No.724 of 2018, F.A. No.1078 of 2018 to 1103 of 2018, F.A. No.1136 of 2018 and F.A.1137 of 2018 are based on identical facts and law are involved between the same parties and also the similar interpretation of law, the State Commission has opted to decide these appeals by way of passing one common order.

4.      It is relevant to make a reference here that against order dated 22.08.2019 in First Appeal No.723 of 2018 by this Commission, complainant filed Revision petition No.2257 of 2019 before the Hon’ble National Commission, copy of the order passed by the Hon’ble National Commission was received wherein directions were issued to this Commission to dispose of the Appeal No.723 of 2018 expeditiously.  On this ground, the appeal No.723 of 2018 has been treated to be a main appeal in which the order regarding the disposal of the remaining appeals would be recorded.

5.      Briefly stated, the facts narrated in the complaint are that the opposite party No.1 had launched a scheme of Gold Souk, Hisar and complainant purchased a shop by depositing Rs.2,00,000/- vide cheque No.142792 dated 01.03.2012.  The complainant was allotted the temporary number of Shop as F-105 at First Floor. The total cost of the shop was Rs.15,40,000/-. The project will be completed by December, 2014 with a grace period of 6 months and advance payment of Rs.3,85,000/- to be paid by the complainant. Agreement was executed between the parties.  In total, the complainant has paid Rs.12,71,856/- till 31.03.2014 out of the total sale consideration of Rs.15,40,000/-.  More than 4 ½ years has been elapsed, but, there was no developmental activities except one skelton structure in the form of pillars has been raised.   On 04.08.2016, he requested the respondents to refund the amount, but, O.Ps. denied to refund.  As per letter dated 04.08.2016 sent by the opposite parties vide which they will hand over the possession of the shop in question till 31.12.2017.  The complainant again requested to refund his money alongwith interest but they flatly refused to accept the request of complainant. Hence the complaint.

6.      O.P Nos.1 to 3 filed their joint written statement by taking various preliminary objections about estoppal, accruing cause of action, locus standi, etc. and requested to dismiss the complaint.

7.      On merits,  the execution of the agreement was denied.  All the developmental work at the spot has already been completed. The project was ready to deliver the possession. The complainant was liable to pay the entire amount towards the costs of the shop, but, the complainant was not having the sufficient fund, has adopted a unique method for filing the present complaint just to harass and humiliate the opposite party.

8.      O.P. Nos.4 and 5 were proceeded against ex parte vide order dated 30.08.2017.

9.      After hearing both the parties, learned District Consumer Disputes Redressal Forum, Hisar (in short ‘District Forum’) allowed the complaint and directed as under:-

“Hence, there is merit in this complaint, the same is hereby accepted with the direction to the respondent Nos.1 to 3 to refund the deposited amount by the complainant alongwith interest @ 9% per annum from the date of filing of the present complaint i.e. from 23.02.2017 till its realization.  The respondents No.1 to 3 are further burdened with compensation and cost of litigation which we quantify at lump-sum amount of Rs.5000/- to be paid to the complainant on account of mental agony, harassment etc. suffered due to the deficient and negligent act of the respondents.”

10.    Feeling aggrieved against the order, O.P. No.1 to 3 have preferred above said appeals as learned District Forum failed to take into consideration all the relevant aspects. It is further prayed that impugned order dated 26.03.2018 passed by learned District Forum, Hisar be set-aside and complaint be dismissed.

11.    This arguments have been advanced by Sh.Amit Singla the learned counsel for all the appellants as well as Sh.Rohit Indora, the learned counsel for the respondent No.1 in all of the complainant and also the other learned counsel for the respondents-complainants as fully referred in the memos of the parties. With their kind assistance the entire appellate record and that of the District Forum has also been properly perused and examined.

12.    As far as the payment of the amount in individual complaint as referred above is not disputed.  The allotment of the unit at fixed price as well as execution of the buyer agreement is also not in dispute.  Since the opposite parties have not been able to maintain the discipline as per the terms and conditions incorporated in the buyers agreement for the purpose of delivery of the possession of the individual units to the complainants as referred above, in spite of the fact that more than a period of eight years had expired, but, the reasons are best known to the present appellants-opposite parties, as to why the possession has not been delivered within the stipulated period to the complainant.  It was also noticed while addressing the arguments that on the proposed date of delivery of possession, the appellants were not having the licence, which has already been cancelled by the State Authorities on account of certain reasons or the facts and circumstances which could not be completed by the builders.          

13.    As far as the order passed by the learned District Forum is concerned, it is well reasoned based on appreciation of law and including the oral as well as documentary evidence and as such, no grounds to interfere in the impugned order dated 26.03.2018  and other respective dates passed by learned District Forum,  Hisar vide which the complaints were allowed and as such, the appeals being devoid of merits stands dismissed, while affirming the order passed by the learned District Forum in all the complaints.

14.              The statutory amount of Rs.25,000/- each deposited at the time of filing of the appeal bearing Nos.723 of 2018, F.A. No.724 of 2018, F.A. No.1078 of 2018 to 1103 of 2018, F.A. No.1136 of 2018 and F.A.1137 of 2018 be refunded to the complainants  against proper receipt and identification.

15.    This order has been rendered in the appeal bearing F.A. No.723 of 2018 and the copies of this order be also placed on the other respective connected appeals as mentioned in the memo of parties.
