Instant Execution Application has been filed by the DH for executing the order of this Forum dated 21/05/2015 in complaint case No. 123/2013 filed by JD vide which JD vide which JD was directed to pay a sum of Rs. 35,238/- along with interest at the rate of 10% per annum from the date of institution of the complaint dated 16/05/2013 till payment Rs. 5,000/- as cost of litigation and to take back the E – bike from the DH after payment and further to pay interest on the entire awarded amount at the rate of 10% per annum in case the above said amount is not paid by the JD within the period of 30 days from the date of the order. As JD did not comply with the order of this Forum instant Execution Application has been filed.
On 31/05/2019 DH offered to deduct Rs. 13,290/- as depreciation value of the E-bike in question in case JD agrees for the same and thereafter E-bike will remain with the DH which was accepted by JD on 26/09/2019. The decretal amount of Rs. (25046 + Rs. 5378 + Rs. 15000/-) total Rs. 45,424/- has been paid to the Counsel for DH after deducting the depreciation value of Rs. 13,290/- as full and final satisfaction of the claim of the DH and hence the E-bike is with the DH. As the Execution Application is satisfied the same is disposed off. File be consigned to record room.
