O R D E R

 

NAWAB SINGH J, (ORAL):

 

          A complaint titled ‘Shweta Vs. Indian Institute of Management Technology and another’ was decided by District Consumer Disputes Redressal Forum, Hisar (for short ‘District Forum’) vide order dated September 29th, 2008.

2.      Aggrieved of the said order, Indian Institute of Management Technology and another-opposite parties filed appeal before this Commission, which was dismissed by order dated March 04th, 2011. The statutory amount deposited by the appellants before this Commission was Rs.25,000/- vide receipt No.584/64 dated October 30th, 2008 and Rs.35,000/- vide receipt No.10213/12 dated August 28th, 2009. However, in the order dated March 04th, 2011 passed by this Commission, it was inadvertently stated that the statutory amount of Rs.25,000/- be refunded to the appellants, whereas, it should have been Rs.25,000/- + Rs.35,000/-, that is, Rs.60,000/-.

3.      It has been stated that the applicants-opposite parties had made the payment of Rs.98570/- vide cheque No.148069 dated December 11th, 2013 to the complainant vide order dated September 06th, 2016. 

4.      By filing the present application, Indian Institute of Management Technology and another have prayed that the amount deposited, that is, Rs.60,000/- be ordered to be refunded.

5.      This being so, the amount of Rs.60,000/- deposited be refunded to Indian Institute of Management Technology-Mahesh Sharan Sharma-applicants against proper receipt and identification in accordance with rules.
