  1. The case of the Complainant is that on 25.08.2023 an employee of the Complainant namely Diya Mallik called the Complainant regarding his marriage as his name is registered with the O.P. for marriage proposals. Diya Mallik sent few photographs of girl namely Madhusmita Padhi along with the Bio-data. As per her version Padhi family was interested with the bio-data of the Complainant. She told to deposit Rs. 5000/-for registration which will be valid for six months. On 29.08.2023 the Complainant went to the office of O.P. and met service Manager namely Dipa Dash, payment was made. On call no body responded from Padhi family. As per O.P’s commitment 6 to 10 profiles of girls from western Orissa will be given. The O.P. till date neither shared such profile nor shared ID and pass-word. When the O.P. was again contacted about Madhusmita Padhi in reply got that her marriage has been finalised. When the Complainant not got any service from the O.P. Lastly on 02.10.2023 Dipa Dash, Service Manager replied that it is not easy to find a suitable girl for marriage and the Complainant has to wait. For unfair trade practice, harassment and for mental suffering this complaint has been filed.
  2. The O.P. has been set ex-parte.
  3. The O.P. has granted receipt of Rs. 5000/- vide receipt No. 72 dated 29.08.2023 and payment made through google pay. In the description the O.P. received the amount for six month, process to provide 6 to 10 proposals with I.D. pass word profile of western Orissa.
  4. After perusal of the statement and document it reveals that the O.P. is running the matrimonial service centre and arranging candidates for unmarried young people both boy and girls. In the present case the OP has violated the terms of agreement and failed to give proposal of 6 to 10 girls candidates to the Complainant. Further in reply the O.P. stated that it is very difficulty to arrange candidates. If it is difficult to arrange then question arises why the O.P. received Rs. 5000/- from the Complainant. It is an unfair trade practice on the part of the O.P.

A young man searching a girl for marriage, paid amount for the proposals but the O.P. not provided a single proposal. Secondly when one proposal was given after enquiry the Complainant got the reply that the candidate girl has got married. It proves that the O.P. is running the service centre without any upto date information and it is not only a harassment but also gave pain to the Complainant. Accordingly following order is passed:

 

ORDER

The complaint is allowed ex-parte against the O.P. The O.P. is directed to refund Rs. 5000/- with 9 % interest w.e.f. 29.08.2023 within one month of this order. In case of non-payment the amount will carry 9% interest per annum till realisation. For harassment and mental agony the O.P. is to pay compensation of Rs. 50,000 to the Complainant.
