EA No.16 of 2018.

Urmila Devi vs. Shri Ram Transport Finance.

 

Present:     None for petitioner.

                  Sh.AS Goyal, Adv. for respondents.

               

                This execution has been called several times since morning but no one has appeared on behalf of complainant/petitioner either in person or through any Advocate up to 3:05PM despite having called several times since morning.  On the another hand the counsel for the respondents placed on record two demand drafts in the sum of Rs.55000/- and Rs.54000/- respectively totaling Rs.109000/- in the name of this Forum.  Both the demand drafts ordered to be sent for clearance and after clearance the same, the amount of Rs.109000/- be disbursed in favour of ht complainants in equal share i.e. to the extent of ¼ share each. The complainant Suryant son of deceased Arvind Kumar is minor and his ¼ share of the total amount is ordered to be released in the Forum of FDR in any Nationalized Bank at Jagadhri through his mother Smt. Urmila Devi and he shall be entitled to encash the said FRD on attaining of his age of maturity and on production of at proof in original FDR.  Branch Manager of the concerned bank shall encash the FDR. It is made clear in case particular from appeared legal heirs of deceased Arvind Kumar Saini, if any another legal heir is left, falling in Class-I such as mother then the four legal heirs who were party in the execution shall equally liable to make payment of share to the another legal heir falling in Class-I of deceased Arvind Kumar Saini.  The present execution be consigned to the records being fully satisfied as no one has appeared before this Forum on behalf of DH.
