ORDER:
Today the case was fixed for arguments. Instead of arguing the case, Mohd. Imran, counsel for the opposite party has made a statement that “company shall disburse the amount to the complainant or furnishing of sound and heavy surety.”
On the other hand, Shri Nisar son of late Shri Ishak r/o House No. 479, Behram Mohalla Patti, VPO Dhauj, District Faridabad has made a statement that “my pending amount as claimed in complaint may be released to me
and if the said amount release to me I shall furnish guarantee to the effect that if one Sohrab for whom I stood as a guarantor for his vehicle loan fails to repay the said loan or company fails to satisfy the loan account of Sohrab form subject matter of loan and his property then I shall be liable for that and OP Shri ram Transport Company shall have right to claim the pending loan amount over Sohrab form me.”
On the basis of the statement of both the parties, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party to pay Rs.3,06,639/- alongwith interest @ 6% p.a. to the complainant from the date of filing of complaint till its realization, subject to furnishing of sound and heavy surety. There are no order as to costs. Compliance of this order be made within 30 days from the date of receipt of copy of this order. Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
