This order is arising out of the M.A. being No.60/2018 filed by the complainant in the C.C. No.190/2017 praying to refund the total excess amount to the complainant.
Heard ld. Lawyers of both sides. The crux of the matter in this Misc. Application is that complainant prays the excess amount of Rs.8138/- has been retained by the O.P and it requires to be refunded to the complainant. To this extent, the complainant prayed for amendment of the plaint. He prays for necessary order on this Misc. Application. After hearing ld. Lawyer for the O.P it appears that the matter can be disposed of only after taking evidence from both sides and at the final stage of hearing of this case. We also think so. Therefore, this M.A. application is thus disposed of keeping the issue open till hearing of the final complaint case. With this direction the M.A is disposed of accordingly.

that the M.A. being No. 60/2018 be and the same is disposed of without any cost.
